Waiver of Liability

The purpose of this Waiver is to acknowledge the inherent risks associated with participating in the CloutX Outdoor Leadership Development Program (hereinafter referred to as "Program") and to release the Organization from any liability arising from such participation.

Acknowledgment of Risks

Participant acknowledges that the Program involves outdoor activities, including but not limited to hiking, climbing, water sports, and other strenuous physical activities, which inherently carry risks of personal injury, property damage, and even death. These risks include, but are not limited to, falls, collisions, equipment malfunction, adverse weather conditions, natural disasters, and the actions of other participants or third parties. Participant further acknowledges that they are voluntarily participating in the Program with full knowledge of these risks.

Assumption of Risk

Participant voluntarily assumes all risks, both known and unknown, associated with their participation in the Program, including those risks that may be caused by the negligence of the Organization, its employees, agents, or volunteers.

Waiver and Release of Liability

In consideration for being permitted to participate in the Program, Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby waives, releases, and forever discharges the Organization, its officers, directors, employees, agents, and volunteers from any and all claims, demands, liabilities, actions, causes of action, costs, and expenses (including attorney's fees) of any nature whatsoever, whether arising in law or in equity, that Participant may have or hereinafter acquire by reason of any injury, death, or property damage arising out of or in connection with their participation in the Program, even if caused by the negligence of the Organization.

Medical Treatment

Participant authorizes the Organization to obtain emergency medical treatment for Participant if, in the sole discretion of the Organization, such treatment is necessary. Participant agrees to be responsible for all costs associated with such medical treatment.

Indemnification

Participant agrees to indemnify and hold harmless the Organization, its officers, directors, employees, agents, and volunteers from and against any and all claims, demands, liabilities, actions, causes of action, costs, and expenses (including attorney's fees) arising out of or in connection with Participant's participation in the Program, including those caused by Participant's negligence or willful misconduct.

Severability

If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the state of California.

 By acknowledging these terms Participant acknowledges that they have read, understood, and agree to the terms of this Waiver.
